She refused to be detained under the Mental Health Act, but agreed to a home treatment assessment. The examiner, however, worried that she could pose a risk to herself or others. She was not convinced she was competent enough to consent.
The assessor then suggested that Miss Kelly should be detained against her will. Miss Kelly did not want to be in a unit so she called Dr Ramanathan Elayaperumal, her psychiatrist. He was a Consultant Psychiatrist within the Home Treatment Team at Essex Partnership NHS Foundation Trust.
In response to the suggestion that was made, the Home Treatment Team performed a thorough assessment of Miss Kelly's current health and mental state. The evaluation included a thorough medical history and physical examination. The review included a detailed psychotherapy assessment, a family therapy assessment and a psychiatric diagnose interview.
According to the report according to the report, Miss Kelly was afflicted by multiple mental health problems, including borderline personality disorder, bulimia nervosa, and anorexia nervosa. She was also assaulted by her husband and was a drug addict. Depression, anxiety, and stress made her suffer more. She was also diagnosed with bipolar affective disorder and schizophrenia-related disorder.
Elayaperumal claims Medtronic discriminated against him intentionally because of his race or nationality. He claims that his poor performance review in June of 2000 as well as the decision not to award him certain assignments were motivated by racism. Medtronic has not provided any evidence that its decisions were based upon these factors. Elayaperumal's lower performance score did not result in a reduction in his compensation or benefits.
